A Lasting Power of Attorney is a legal document that allows you (the ‘donor’) to appoint one or more trusted individuals (known as ‘attorneys’) to make decisions on your behalf. There are two types of LPA:

 

  • Health and Welfare LPA:
    This covers decisions about your medical care, daily routine, and living arrangements. This type of LPA only comes into effect if you lose the capacity to make decisions yourself.

  • Property and Financial Affairs LPA: 
    This covers decisions about your finances, such as managing bank accounts, paying bills, or selling property. This type of LPA can be used as soon as it is registered, with your permission.

THE PROCESS

Creating a Lasting Power of Attorney involves the following steps:

1.  Initial Consultation:

We will discuss your needs and explain the different types of LPAs to help you decide which is right for you.

4. Certificate Provider:

A certificate provider will confirm that you understand the LPA and are making it voluntarily.  We offer this service as standard and as part of our fixed fee.

2. Choosing Attorneys:

You will appoint one or more trusted individuals to act on your behalf. We can guide you in making this important decision.

We will submit your LPA to the Office of the Public Guardian for registration, which typically takes 10 – 12 weeks.

3. Drafting the LPA:

We will prepare the legal documents, ensuring they are accurate and reflect your wishes.

CHARGES

We believe in transparency and aim to provide clear, straightforward information about our fees. All initial consultations are free and with no obligation. Below is a breakdown of our typical charges for Wills.

Our Lasting Power of Attorney service is frequently tied into to wider estate planning, including Wills and tax planning. 

 

Where we are doing more than one job at a time we will bundle our costs, providing a single fixed fee which will usually include a discount.

Note:

These costs include the legal costs for registration of the LPA’s but do not include expenses. 

 

Expenses would include the registration fee payable to the Office of the Public Guardian, which is £82 per document, and ID checks, which are £10 plus VAT per person.
